Terms of Service

These Terms of Service ("Terms") govern your use of the Nyro Quest mobile application ("App") operated by Nyro Dynamics Ltd ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a Parent account or Self-Learner account. Children may only use the App through a Family Mode profile created and managed by their Parent or legal guardian. By creating a Child profile, you represent that you are the Child's parent or legal guardian and that you consent to the Child's use of the App in accordance with our Privacy Policy and Children's Privacy Notice.

2. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account, including activity by Children using profiles you created or activity in your Self-Learner profile.
• You agree to provide accurate information during registration.
• You must notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App's functionality
• Submit false, misleading, or inappropriate content through any feature (including feedback)
• Use automated scripts, bots, or scrapers to access the App
• Reverse-engineer, decompile, or disassemble any part of the App

4. Educational Content

The App provides educational content including lessons, quizzes, and learning quests. This content is provided for informational and educational purposes only. We make reasonable efforts to ensure accuracy but do not guarantee that all content is error-free or complete. Educational content may be updated, modified, or removed at any time.

4.1 Parent-Created, Self-Learner, and AI-Generated Content

The App includes tools that let Parents and Self-Learners create their own missions, including features that use artificial intelligence ("AI") to draft lessons, slides, quizzes, games, and images from text prompts and/or uploaded reference materials ("User AI Content").

• AI can be wrong. User AI Content is generated by third-party AI models and may contain factual errors, biased phrasing, outdated information, fabricated citations, culturally inappropriate material, or images that do not match the subject matter, are low quality, or are otherwise unsuitable. AI output is provided "as is" without any warranty of accuracy, fitness, educational quality, image quality, or age-appropriateness.
• Adult control before child use. Before a Parent-created AI mission is assigned to a Child, the Parent who created it sees an in-App AI draft notice and can edit text, add or remove photos, regenerate slides, images, quizzes, or games, or save the draft for later. Some sensitive or flagged topics may require a more detailed in-App review before publishing.
• Parent responsibility. By publishing Parent-created content for a Child, you represent that (a) the content is ready for the intended Child, (b) the content is age-appropriate, factually correct to your knowledge, educationally suitable, and free of material you would not want your Child exposed to, (c) any generated images are appropriate for the intended Child and learning context, (d) you own or have the right to use any materials you uploaded as references, and (e) the content does not infringe any third party's rights or violate any law. You are solely responsible for deciding what to publish, assign, and monitor once a Child can access it.
• Self-Learner responsibility. Self-Learners are responsible for the prompts, uploaded materials, and generated missions they create for their own use.
• Our role. Nyro Dynamics Ltd hosts and delivers User AI Content but does not pre-screen, edit, endorse, approve, or verify it for factual accuracy, educational quality, image quality, age-appropriateness, or suitability. We are not the author, publisher, or educator with respect to User AI Content. To the fullest extent permitted by law, we disclaim all liability for User AI Content, including any harm, offence, unsuitable image, low-quality output, or educational inaccuracy arising from its use.
• Moderation. We may, but are not obligated to, review, suspend, or remove User AI Content that we believe violates these Terms, our acceptable-use policy, or applicable law. Removal does not refund AI generation credits that have already been consumed.

5. Quests and Rewards

Parents can create quests and assign real-world rewards (e.g., "pizza night," "screen time"). These rewards are commitments between Parent and Child. Nyro Dynamics Ltd is not responsible for fulfilling, enforcing, or mediating any rewards set by Parents. XP points, levels, and similar in-App progress indicators have no monetary value.

6. Intellectual Property

All content, design, code, graphics, and trademarks in the App are owned by Nyro Dynamics or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent. Your use of the App does not grant you any ownership rights.

7. Termination

You may delete your account from the App's Account / Profile screen or by contacting us at info@nyroquest.com. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the App ceases immediately. We will delete or anonymize personal data in accordance with our Privacy Policy, except for limited records we must retain for purchase reconciliation, tax, accounting, fraud-prevention, dispute, security, or legal obligations. Active App Store or Google Play subscriptions must be cancelled through the applicable store.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Nyro Dynamics Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or CAD $50, whichever is greater.

10. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia, Canada, except where mandatory consumer protection laws in your jurisdiction provide rights or forums that cannot be waived by contract.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the App or email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the App and delete your account.
